Fair Opportunity

NASA SEWP VI is a multi-award Government-Wide Acquisition Contract. Agileana holds one of many contracts awarded under the program. No contract holder has exclusive rights to any technology or service, and no agency is limited in which contract holders it may consider.

Fair Opportunity Clause — A.1.13, as stated in the contract

Contractors will be provided a fair opportunity at the individual order level as appropriate per FAR Part 16.505(b), including the SEWP RFQ tools. No documentation for the order selection is required to be submitted with the order. All such documentation is to be maintained by the issuing procurement office.

The Contractor shall not market, quote or otherwise offer for sale, any IT solutions not listed under this contract, until the said solutions are included in the SEWP database of record, and available to all Government end-users.

Under FAR 16.505(b) the ordering contracting officer gives each contract holder in the applicable category a fair opportunity to be considered for orders above the micro-purchase threshold. The ordering agency makes the award decision.

Installation, warranty, and support after delivery

Agileana delivers services rather than hardware, so delivery means working software in your environment and a team that stays reachable after go-live. Terms in your order take precedence over these standard policies.

  • Installation and deployment. Deployment into agency-controlled cloud or on-premise environments, with CI/CD pipeline configuration, environment documentation, and a knowledge transfer session for agency staff.
  • Basic warranty. Defect correction on delivered code and configuration at no additional cost, measured from acceptance. Warranty period 90 days. Extended maintenance, covering security patching, core and module updates, dependency upgrades, and regression testing, is available as a separately priced line item.
  • Technical support. Ticketed support Monday through Friday, 9:00 a.m. to 6:00 p.m. Eastern Time, excluding federal holidays. Standard response targets, unless the order specifies otherwise:
    • Critical (site down or security incident): response within 2 business hours
    • High (major function impaired, no workaround): response within 4 business hours
    • Normal (minor defect or workaround available): response within 1 business day
    • Low (questions and enhancement requests): response within 2 business days
    • After-hours and 24x7 coverage are available as a priced option.
  • Software support. For open-source components Agileana delivers, we provide upgrade paths and security advisories. For third-party licensed software, we coordinate with the publisher and remain your single point of accountability.
  • Accessibility conformance. Delivered interfaces are tested against Section 508 and WCAG 2.1 Level AA. An Accessibility Conformance Report is available on request for any delivered application.

If something goes wrong with an order
